Kishan and his brother run a small handicraft export business from Bhuj, set up as a partnership firm. Most weeks, he drives to weavers in Bhujodi and block printers in Ajrakhpur. He also travels to the port when required.

They need a car for that work and the question is whose name it goes in. Gujarat taxes a car registered to an individual at half the rate it charges a business.

RTO Bhuj operates under the code GJ-12 and is located in the RTO Relocation Site area of Bhuj. It handles registration, driving licences, permits, fitness certification and motor vehicle tax for its jurisdiction.

Many people search for RTO Circle Bhuj when looking for this office. RTO Circle is the nearby landmark. The office itself is the GJ-12 RTO in the RTO Relocation Site area.

The Commissionerate does not publish counter hours for this office. all before travelling to confirm the counter timings for your service.

GJ-12 and GJ-39: which office covers Kutch?

Kachchh has more than one registering authority, so not every address in Kachchh falls under GJ-12.

GJ-12 is RTO Bhuj. GJ-39 is separately assigned to ARTO Anjar. That is the Assistant Regional Transport Office for its own area.

GJ-12 should therefore not be assumed to cover every address in Kachchh. Kachchh is India's largest district by area, and distances between its towns can be considerable.

The Commissionerate publishes no current document dividing the district's localities between the two offices. Confirm your jurisdiction with the office before travelling.

If your vehicle already carries a GJ-12 number, RTO Bhuj holds its record.

How to register a vehicle at RTO Bhuj

Registration has five stages and a dealer usually files it for a new vehicle.

  1. Submit Form 20 with your supporting documents, at the office or on the Parivahan portal.

  2. Pay motor vehicle tax and the registration fee. Keep the receipt.

  3. Vehicle inspection. An officer checks the engine and chassis numbers.

  4. Verification and approval. The office assigns a permanent registration number.

  5. RC issued. The certificate is dispatched to your registered address.

A dealer-issued temporary registration is valid for 30 days. Apply for permanent registration within that period.

Documents required for vehicle registration

The document set is the same whether you or your dealer files it.

  • Form 20, the application for registration

  • Form 21, the sale certificate from the dealer

  • Form 22, the roadworthiness certificate from the manufacturer

  • Form 34, where the vehicle is financed

  • Valid motor insurance certificate

  • Proof of identity and proof of address

  • Sales invoice from the dealer

  • PAN card or Form 60 where no PAN is held

  • Pollution Under Control certificate, where applicable

  • Passport-size photographs

A vehicle registered to a business also needs the business's own registration documents.

How much is road tax in Gujarat?

Gujarat charges a lump-sum motor vehicle tax of 6% of vehicle cost on a new car or motorcycle registered to an individual.

The rate is flat. There are no price bands. A Rs. 6 lakh car and a Rs. 30 lakh car are subject to the same percentage rate.

Table: Gujarat lump-sum motor vehicle tax on a new private vehicle

Owner or vehicle

Tax

Car registered to an individual

6% of vehicle cost

Motorcycle registered to an individual

6% of vehicle cost

Vehicle owned by a company or other non-individual owner

Generally twice the normal rate

Imported vehicle

Generally twice the normal rate

Universities, education trusts, public trusts and social welfare bodies are treated separately from the doubled rate.

For an ordinary private registration, Gujarat's current tax table lists no additional cess or road safety tax.

However, 6% is not the total amount payable. Registration fees, HSRP charges and hypothecation fees where applicable are all separate.

How ownership affects the tax: Using an illustrative price for the car Kishan's firm is considering:

Table: Illustrative tax on one car registered two ways

6%

Rs. 72,000

The partnership firm

Rs. 12,00,000

12%

Rs. 1,44,000

Registering the car to the firm doubles the tax, resulting in an additional Rs. 72,000. Registering it to Kishan halves it, though the car is then his rather than the business's.

The car will primarily be used for business purposes. It will run between village workshops and the port. How the car is accounted for in the firm's records is also relevant to the brothers.

These are illustrative numbers, so confirm the vehicle cost and tax on your own invoice with the dealer.

Road tax when you buy a used vehicle

The resale of a vehicle attracts a transfer tax calculated on the lump-sum tax originally paid, not a fresh percentage of the vehicle's value.

Table: Gujarat transfer tax on a used private vehicle

Age of vehicle at transfer

Transfer tax

Up to 8 years

15% of the lump-sum tax originally paid

Over 8 years

1% of the lump-sum tax paid or Rs. 100, whichever is higher

The buyer should ask the seller what lump-sum tax was paid at first registration. The transfer tax cannot be worked out without it.

How to transfer vehicle ownership

A used vehicle must be transferred into the buyer's name within 30 days of purchase.

  1. Complete Form 29, the notice of transfer and Form 30, the report of transfer, signed by buyer and seller.

  2. Gather the original RC, a valid insurance certificate and a PUC certificate.

  3. Add the buyer's identity and address proof and a pencil print of the chassis and engine numbers.

  4. Get a No Objection Certificate from the financier if a loan is registered against the vehicle.

  5. Submit the file at the office where the vehicle is registered and pay the transfer fee.

The transfer fee is half the registration fee for the vehicle's category. Gujarat's transfer tax is charged in addition.

The insurance policy must be moved into the buyer's name separately. Otherwise, the new owner may not have own damage protection under the policy.

When you need an NOC

Moving a GJ-12 vehicle to another state needs a No Objection Certificate from this office.

The new state's RTO asks for the NOC before it re-registers the vehicle. Apply on Form 28, either at the office or on the Parivahan portal.

Clear any pending challans and tax dues first, since the office checks for them. If a loan is registered against the vehicle, the financier's consent is also needed.

An NOC is normally valid for six months. Complete re-registration in the new state within that period.

Why insurance comes before registration

A vehicle cannot be registered in India without a valid insurance certificate in force.

Third-party cover is the legal minimum under Section 146 of the Motor Vehicles Act, 1988. New private cars are issued a bundled policy. It carries three years of third-party cover with one year of own damage cover.

Driving without valid insurance carries Rs. 2,000 for a first offence, rising to Rs. 4,000 for a repeat. You also remain personally liable for third-party compensation awarded against you.

Comprehensive cover is worth weighing against third-party alone in Kutch. Long runs between towns, heavy port traffic and desert road conditions are not covered under a third-party policy .

Zurich Kotak General Insurance Company (India) Limited covers cars and two-wheelers . Options include comprehensive, third-party and standalone own damage policies .

Conclusion

Confirm which office covers your address before you travel. Kachchh has two registering authorities, at GJ-12 and GJ-39.

Decide whose name a vehicle goes in before you register it. In Gujarat, a business pays double the tax an individual pays on the same vehicle.

Kishan has sent the dealer's quote to the firm's accountant. The brothers will decide whose name the car should be registered in after reviewing the quote together.
